By accessing or using our services, including our website and remote/onsite IT support, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our services.

1. Services Provided

FusionEdge IT Services offers IT support services including but not limited to:

  • Remote desktop support via software such as TeamViewer and AnyDesk
  • Onsite support at your location
  • Hardware sales
  • Managed IT services
  • Consulting services

We aim to provide professional and reliable services to meet your IT needs. The scope of our services will be agreed upon in writing, via email, or through a service-level agreement.

2. Pricing and Payment Terms

  • All pricing for our services is provided upfront or in an agreed quotation. Prices are subject to change, and we will notify you of any adjustments before commencing work.
  • Payment is due upon receipt of the invoice, unless otherwise specified in writing. We accept payments via bank transfer, credit card, or other methods as agreed.
  • A retainer fee may be required for certain services, particularly for managed services or ongoing support agreements.
  • Late payments may incur a fee or result in suspension of services until payment is made.

3. Service Availability

While we strive to ensure the availability and continuity of our services, we do not guarantee uninterrupted or error-free performance. Downtime or interruptions may occur due to maintenance, technical issues, or other unforeseen events. We will make reasonable efforts to inform you of any planned disruptions and restore services as quickly as possible.

4. Client Responsibilities

  • You agree to provide accurate and complete information necessary for us to provide services. Any delays or issues caused by incomplete or incorrect information are not the responsibility of FusionEdge IT Services.
  • You must ensure that your hardware and software are properly licensed and comply with legal requirements. We are not responsible for any software or hardware-related issues arising from illegal or unauthorized use.
  • You agree to provide access to relevant systems, data, and personnel as necessary for us to perform the services.

5. Remote Support and Access

For remote IT support, you will be required to download and install remote access software such as TeamViewer or AnyDesk. By allowing remote access, you agree that:

  • We will access your system only for the purposes agreed upon.
  • We will not access your personal or sensitive data unless it is necessary to perform the service.
  • You have the right to terminate the remote session at any time.
  • We are not responsible for any data loss, corruption, or issues caused by factors beyond our control.

6. Hardware Sales and Warranty

For hardware purchased through FusionEdge IT Services:

  • All hardware sales are subject to availability and pricing at the time of purchase.
  • Hardware may come with manufacturer warranties, which will be communicated to you at the time of sale.
  • We are not responsible for defects or failures in hardware caused by misuse, improper installation (unless installed by us), or external factors.

7. Limitation of Liability

To the fullest extent permitted by law, FusionEdge IT Services will not be liable for:

  • Any indirect, incidental, special, or consequential damages arising from the use of our services or hardware.
  • Loss of profits, business, data, or other intangible losses, even if advised of the possibility of such damages.
  • Any claims arising from incorrect use of software or hardware not provided or installed by us.

Our total liability, whether in contract, tort, or otherwise, will not exceed the amount paid by you for the specific service giving rise to the claim.

8. Cancellation and Termination

  • You may cancel or terminate a service agreement by providing written notice, subject to any applicable cancellation fees, particularly for hardware orders or services already rendered.
  • We reserve the right to suspend or terminate services if we have reason to believe these Terms have been violated or if payment has not been received.

9. Intellectual Property

All intellectual property rights related to our services, including but not limited to software, processes, documentation, and branding, remain the property of FusionEdge IT Services. You may not reproduce, distribute, or use any of our intellectual property without our prior written consent.

10. Confidentiality

We respect your privacy and confidentiality. Any information shared with us in the course of providing services will be treated as confidential and will not be disclosed to third parties without your consent, except where required by law.

11. Governing Law

These Terms and any disputes arising from the use of our services will be governed by and construed in accordance with the laws of South Africa.

12. Changes to Terms and Conditions

We reserve the right to update or modify these Terms at any time. Any changes will be posted on our website and will take effect immediately. Your continued use of our services after any changes have been made constitutes acceptance of the updated Terms.
